One of the most common questions we get is: "Can you patent a business idea?"

The short answer is no. You cannot patent an idea, generally speaking. You can patent a method, a process, or a machine, but you cannot patent the abstract concept of "Uber for Dog Walking."

This terrifies many first-time founders. They freeze up, refusing to share their concept for fear of it being stolen. But this secrecy is often more damaging than the risk of theft.

How to Share a Business Idea Without It Being Stolen

If you can't patent it, how do you talk to investors or partners? How to protect your business idea from being stolen comes down to legal frameworks and strategic sharing:

  1. Non-Disclosure Agreements (NDAs): Use these when sharing detailed technical specifications or proprietary data with potential partners or contractors. Note: Most VCs will refuse to sign NDAs for pitch meetings.
  2. Trademarks: You can protect your brand name, logo, and slogan. This prevents competitors from masquerading as you.
  3. Copyright: This protects your written code, website content, and creative assets.

The "Execution is Protection" Mindset

The harsh reality is that ideas are cheap. Execution is expensive.

Even if you told everyone your idea for the next Facebook, 99.9% of people wouldn't have the time, money, or skill to build it better than you. The best way to protect an idea for a business is to:

  • Build it faster than anyone else.
  • Build a brand that customers trust.
  • Create a "moat" through network effects or high switching costs.

When to Be Careful

While we advocate for sharing, there are exceptions. Keep "secret sauce" algorithms or unreleased technical breakthroughs confidential until they are protected by IP laws or released. But for the general business concept? Get feedback early and often.
